III. RIGHT TO INFORMATION
ACT (RTI ACT), 2005
RTI Act 2005 has been enacted with the intent of facilitating the
right of Citizens to obtain
information from public authorities and to promote transparency and
accountability of public
authorities. The Citizens are entitled to get any ‘information’ which
term includes material in any
form be it documents, records, opinions, advices, Circulars, Contracts,
Press releases, Email
etc., held in electronic form or in any other form.
Section 8 of the Act stipulates the exemptions from disclosure of
information. The common
exemptions which are applicable to Banks are ‘commercial confidence’, ‘matters
of fiduciary
nature’ and ‘personal information not involving any public
activity or interest’, and ‘unwarranted
invasion of privacy’.
These information are made accessible through a designated person ‘Public
Information
Officer (PIO)’ and appeal, if any shall be made to the next
higher authority in the said
organization within 30 days of decision rendered by the PIO. Second
appeal is open to be
made to Central Information Commission within 90 days.
